Change of date for resumption of proceedings
With reference to BioPorto's earlier announcement no.12 of May 5, 2009, it is hereby notified that the European Patent Office (EPO) has changed the date for the resumption of grant proceedings regarding BioPorto’s NGAL patent in Europe, application EP 1 831 699 to October 1, 2009 as the EPO did not include the period in which the case can be appealed in the original deadline on June 3, 2009.
The change in date is already evident from EPO’s website. BioPorto expects EPO to publish a letter regarding the change of date. This announcement is based on telephoned information received from BioPorto’s patent advisor, Høiberg A/S. It has not been possible to gain access to the expected letter from EPO prior to its publication on EPO’s website one of the following days.
The change of date does not involve a change in the handling of the case by EPO.
